TERMS OF SERVICE (“Terms”)

Welcome to MyDoorView, Inc. (“MyDoorView,” “we,” “us,” or “our”). They govern your access to and use of our website located at https://mydoorview.com (the “Website”) and our property‑management software platform and mobile application, together with any related content, tools, or features (collectively with the Website, the “Services”). Our principal place of business is 5600 Oakbrook Pkwy #240, Norcross, GA 30093. Please review these Terms carefully, as they include important information about your legal rights.

By visiting the Website or by downloading, installing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Services.

Throughout these Terms, “you” refers to the individual who uses the Services. If you are acting on behalf of a company or other legal entity, you confirm that you have authority to bind that entity, and every obligation and representation you make here applies to the entity as well. If a separate written subscription agreement between MyDoorView and you (or the entity you represent) covers your use of the Services, that agreement prevails to the extent it conflicts with these Terms.

WHO MAY USE THE SERVICES. You must be at least eighteen years old and reside in the United States or one of its territories to use the Services. By using the Services, you represent that you satisfy these requirements.

Creating and Protecting Your Account. To access certain features, you may need to create an account. You agree to provide accurate, current information and to keep that information updated. You are solely responsible for safeguarding your login credentials and for all activity that occurs under your account. If you become aware of any unauthorized use or other breach of security, you must notify us immediately.

Privacy. Our Privacy Policy, available at https://mydoorview.com/privacy-policy/, explains how we collect, use, and protect your information when you interact with the Services. By using the Services, you consent to the practices described in the Privacy Policy.

License Grant. Subject to your ongoing compliance with these Terms, MyDoorView grants you a limited, personal, non‑exclusive, non‑transferable, revocable, worldwide license to access and use the Services and to download and operate the App on a device that you own or control for your own non‑commercial purposes. MyDoorView may modify, suspend, or discontinue the Services at any time and for any reason.

Prohibited Conduct. You agree not to directly or indirectly:

  • use the Services for commercial purposes without our prior written consent;
  • reproduce, distribute, publicly display, or create derivative works from the Services or their content except as expressly permitted here;
  • decompile, reverse engineer, or otherwise attempt to discover the source code or underlying algorithms of the Services;
  • interfere with or disrupt the normal operation of the Services or any networks connected to them;
  • bypass or disable any security or technological features of the Services;
  • introduce viruses, malware, or other harmful code;
  • use automated means—such as robots or scrapers—to access or collect data from the Services;
  • use the Services for any unlawful, harassing, or unethical purpose; or
  • violate any applicable law or regulation in connection with your use of the Services.

USE OF THE SERVICES. The availability of the Services depends on your device, internet connection, and mobile operator. MyDoorView does not guarantee that the Services will be compatible with your hardware or that they will be available in any specific location. We may send you emails, text messages, or in‑app notifications. You may manage most notification preferences in your device or account settings, but your carrier may charge data or messaging fees.

Additional Terms for Apple Users. If you obtain the App through the Apple App Store, you acknowledge that these Terms are between you and MyDoorView, not Apple, and that Apple has no responsibility for the App. Apple has no obligation to provide maintenance or support. If the App fails to conform to an applicable warranty, you may notify Apple and request a refund of any purchase price you paid. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.

Intellectual Property. “MyDoorView” and the associated logos and designs are trademarks of MyDoorView or its licensors. The Services and all content made available through them, including their design, text, graphics, and software, are protected by copyright, trademark, and other laws. Except for the limited license granted above, nothing in these Terms conveys any right or interest in or to MyDoorView’s intellectual property.

Feedback. You acknowledge and expressly agree that any feedback, comments, and suggestions for improvements to the Services that you provide to us (“Feedback”) become the sole and exclusive property of MyDoorView, and MyDoorView may use and disclose Feedback in any manner and for any purpose whatsoever without further notice or compensation to you and without retention by you of any proprietary or other right or claim. You hereby assign to MyDoorView any and all right, title, and interest (including, but not limited to, any patent, copyright, trade secret, trademark, show‑how, know‑how, moral rights, and any and all other intellectual property right) that you may have in and to any and all Feedback.

Disclaimers. You understand and agree that the Services are provided to you on an “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE” basis. Without limiting the foregoing, to the maximum extent permitted under applicable law, MyDoorView, its parents, affiliates, related companies, officers, directors, employees, contractors, agents, representatives, partners and licensors (the “MYDOORVIEW ENTITIES”) DISCLAIM ALL, AND MAKE NO, WARRANTIES OF ANY KIND (WHETHER EXPRESS, STATUTORY, IMPLIED OR OTHERWISE ARISING IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE), EXCEPT FOR ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, INCLUDING WITHOUT LIMITATION (A) THE CONDITIONS AND/OR WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR LOSS OF DATA; (B) the completeness, accuracy, availability, timeliness, security or reliability of the Services; (C) any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services; (D) the operation or compatibility with any other application or any particular system or device; and (E) whether the Services will meet your requirements or be available on an uninterrupted, secure or error-free basis. No advice or information, whether oral or written, obtained from the MyDoorView Entities or through the Services, will create any warranty or representation not expressly made herein.

Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, AND EXCEPT TO THE EXTENT RESULTING FROM THE MYDOORVIEW ENTITIES’ GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT, YOU AGREE THAT IN NO EVENT WILL THE MYDOORVIEW ENTITIES BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER ARISING FROM CONTRACT, STRICT LIABILITY, TORT (INCLUDING NEGLIGENCE OR OTHERWISE) OR ANY OTHER CAUSE OF ACTION, EVEN IF THE MYDOORVIEW ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, INCLUDING, BUT NOT LIMITED TO: (A) PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS OF USE, DATA OR PROFITS OR BUSINESS INTERRUPTION; (B) ANY ACTS OR OMISSIONS OF ANY INDIVIDUAL THAT YOU LET INTO ANY BUILDING OR PREMISES, OR DAMAGE TO OR LOSS OF ANY PERSONAL PROPERTY OR BUILDING; (C) PERSONAL INJURY OR LOSS OF LIFE ARISING FROM YOUR USE OF THE SERVICES; OR (D) ANY OTHER CLAIM, DEMAND OR DAMAGES WHATSOEVER RESULTING FROM OR ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE DELIVERY, USE OR PERFORMANCE OF THE SERVICES. SOME JURISDICTIONS (SUCH AS THE STATE OF NEW JERSEY) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. NOTWITHSTANDING THE FOREGOING, IF A COURT OF COMPETENT JURISDICTION FINDS MYDOORVIEW LIABLE TO YOU, THEN THE MYDOORVIEW ENTITIES' TOTAL LIABILITY TO YOU FOR ANY DAMAGES FINALLY AWARDED IN ANY MATTER ARISING FROM, RELATED TO OR CONNECTED WITH THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNT OF TWENTY-FIVE U.S. DOLLARS ($25.00). THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnification. You agree to defend, indemnify, and hold harmless the MyDoorView Entities from all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) incurred by the MyDoorView Entities arising out of or in connection with: (A) your access of or use of the Services; (B) the acts or omissions of any individual that you let into any building or premises; (C) your violation or breach of any term of these Terms, any applicable law or regulation, or the rights of any third party; or (D) your negligence or willful misconduct. MyDoorView reserves the right, at its own expense, to assume the exclusive defense and control of any matter for which you are obligated to indemnify MyDoorView. If MyDoorView chooses to assume the defense of any matter that is subject to indemnification by you, you will cooperate with MyDoorView, at its expense, in any respect reasonably requested by MyDoorView.

Updates to the Terms. We may revise these Terms from time to time. When we do, we will update the “Last updated” date above and, if the changes are material, make reasonable efforts to notify you. By continuing to use the Services after revised Terms become effective, you agree to the revised Terms.

Termination. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe that you have violated these Terms or if we discontinue the Services. Sections that by their nature should survive termination—including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification—will survive.

Injunctive Relief. You agree that a breach of these Terms may cause MyDoorView irreparable harm for which monetary damages are an inadequate remedy and that MyDoorView may obtain injunctive relief without posting a bond.

California Notice. Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs at 5600 Oakbrook Pkwy #240, Norcross, GA 30093, or by telephone at (888) 575-6815.

Miscellaneous. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. You may not assign these Terms without our prior written consent; we may assign them freely. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. These Terms are governed by the laws of the State of Georgia without regard to conflict‑of‑laws principles, and any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Norcross, Georgia, to whose jurisdiction you consent.
